
The Chief Magistrate Court I sitting in Yola, Adamawa state has remanded a businessman, Mamuda Duma, for allegedly having an affair with a married woman and aborting her 3 months old pregnancy.
The court issued the remand order when the defendant was arraigned following a direct criminal complaint lodged against him by the woman’s husband, Ahmadu Lawal.
In his complaint, Lawal of Yola town in Yola South LGA, told the court that the defendant who resides at Wurojabbe was having an extra marital affair with his wife.
Lawal told the court that he had found out sometime in August, 2024, that the defendant was committing adultery with his wife, saying that he called him on phone 3 consecutive times and warned him to stop it, but to no avail.
According to him, the defendant had asked his wife to abort her 3 months pregnancy which she did, saying that he reported the defendant at the police headquarters in Yola, for Intervention.
He narrated that the defendant alongside some of his friends pleaded with him to withdraw the case with a promise that he will never come close to his wife anymore.
The complainant asserted that he later withdrew the case following the Intervention, but according to him, the defendant didn’t stop calling his wife on the phone.
Lawal said he had recorded the conversation between his wife and the defendant.
He stated that the act and conduct of the defendant amounts to “enticing and abortion” contrary to section 315 and 203 of the penal code law Adamawa state 2018.
When the particulars of the complaint was read to the defendant following an application by Counsel to the Complainant, Ibrahim Hamman Gurin, he denied all the allegations.

Thereafter, the court presided by Chief Magistrate Muhammed Njidda, ordered that he should be remanded in prison custody and adjourned the case to the 1st September, 2025 for commencement of trial.
